The Site is in principle available 24 hours a day, 7 days a week, except for interruptions, scheduled or otherwise, required for maintenance, security, or in case of force majeure.

The publisher is under no obligation of result as to the availability of the Site. It may modify, suspend or interrupt access to all or part of the Site at any time, without notice or compensation.

5. Terms of use

5.1. Purpose

These terms of use (the “Terms”) define the conditions of access to and use of the Site by any visitor or user (the “User”).

Browsing the Site implies full acceptance of these Terms. If the User does not agree, they should not use the Site.

The Terms do not govern the use of HANDI ACCESS as a service by ambassadors and HANDICAP TV management; that use is covered by separate contractual terms (GTC / SaaS agreement).

5.2. Permitted use

The User agrees to use the Site in compliance with:

• applicable laws and regulations;
• the rights of third parties;
• these Terms.

In particular, the User must not:

• use the Site for unlawful purposes or contrary to public order;
• impair the integrity or operation of the Site, including by introducing malware;
• attempt unauthorised access to information systems or data of the publisher or third parties;
• collect information about other users or data on the Site by fraudulent means.

5.3. Content

Information published on the Site is provided for information only. Despite the care taken in drafting and updating it, the publisher cannot guarantee that it is accurate, complete or permanently up to date.

Information on the Site does not constitute a contractual offer or professional advice (legal, tax, financial, technical or otherwise). The User remains solely responsible for the use made of information available on the Site.

The Site may contain hyperlinks to third-party sites that are neither operated nor controlled by the publisher. The publisher cannot be held liable for the content, security or operation of those sites.

Any hyperlink to the Site requires the publisher’s prior written authorisation.

5.5. User account and platform access (where applicable)

The public website is distinct from the HANDI ACCESS platform. Access to the HANDI ACCESS area and its features requires a specific contract and a dedicated user account.

Account creation, use and deletion, and the parties’ respective commitments, are defined in the specific contractual documents provided by the publisher and fall outside these Terms.

6. Intellectual property

6.1. Rights in the Site and its content

The Site and all of its elements, including without limitation: texts, images, graphics, logos, trade marks, domain names, videos, sounds, overall structure, tree structure, interfaces, graphic charter, as well as the software and any other element making up the Site (the “Protected Elements”) are protected by intellectual property law.

Unless expressly stated otherwise, all intellectual property rights in the Protected Elements are owned exclusively by the publisher or its partners or licensors. The HANDI ACCESS trade mark is used by the publisher.

6.2. Licence

The User is granted only a non-exclusive, non-transferable licence strictly limited to private, non-commercial use of the Site on the internet.

Any reproduction, representation, modification, adaptation, translation, exploitation, extraction or reuse, in whole or in part, of the Site or of any Protected Element, by any means and on any medium, without the publisher’s prior written authorisation, is strictly prohibited and may constitute infringement.

When using the Site, personal data may be collected and processed, in particular through:

• contact and listing forms;
• account authentication;
• cookies strictly necessary for the Site to function.

The User is invited to read that document carefully for further information on the processing of their personal data.

8. Cookies and similar technologies

The Site uses cookies and similar technologies, in particular for:

• technical purposes (cookies required for the Site and for authentication);

No audience-measurement, analytics or marketing-automation cookie is currently set.

9. Liability

9.1. Publisher’s liability

The publisher cannot be held liable for:

• damage of any kind arising directly or indirectly from use of the Site or inability to access it;
• damage arising from the content, use or unavailability of third-party sites linked from the Site;
• damage arising from use of the Site that does not comply with these Terms.

The User remains solely responsible for their use of the Site and of the information available on it.

9.2. User’s liability

The User is solely liable for any damage, direct or indirect, of any kind, caused to the publisher or to third parties through use of the Site or breach of these Terms.

The User agrees to indemnify the publisher against any third-party claim arising from unlawful or non-compliant use of the Site.

10. Security

The publisher takes reasonable steps to secure the Site and the data that transit through it. The User nevertheless acknowledges that integrity, authentication and confidentiality of information cannot be guaranteed on the internet.

It is for the User to take appropriate measures to protect their own data and equipment (firewall, antivirus, backups, etc.).

11. Governing law and jurisdiction

Subject to any mandatory provisions that may apply by reason of the User’s location or the nature of the processing, these Terms and use of the Site are governed by French law.

In the event of a dispute relating to the interpretation, validity or performance of these Terms, and failing an amicable resolution, exclusive jurisdiction is conferred on the courts that have subject-matter and territorial jurisdiction in the Saint-Quentin district, notwithstanding multiple defendants or third-party proceedings.

12. Updates to this notice

The publisher may amend these legal notices and Terms at any time, in particular to reflect changes to the Site, legislation or applicable regulation.

The version in force is the one available online on the date the User consults the Site.
